According to RERA (Real Estate Regulation and Development Act, 2016), just enrolled land operators can encourage the deal/buy of properties in a land ventures enlisted u/s 3 of the Act. Presently, no land specialist can encourage the deal/buy of properties in a land ventures enlisted u/s 3 of the Act without getting enrollment under section 9. According to segment 2(zm) “Real Estate Agent” – implies any individual:
i. who arranges or follows up for the benefit of one individual in an exchange of exchange of his plot, loft or working, all things considered, in a land venture, by method for deal, with someone else or exchange of plot, condo or working, by and large, of some other individual to him; and
ii. gets compensation or expenses or some other charges for his administrations whether as commission or something else; and
iii. incorporates a man who presents, through any medium, planned purchasers and merchants to each other for transaction available to be purchased or buy of plot, flat or working, by and large; and
iv. Incorporates property merchants, intermediaries, brokers by whatever name called.
So according to point (iii), every one of the sites might come extremely close to Real Estate Agent.
Enlistment of Real Estate Agent – Sec. 9
i. No real estate agent can encourage the deal/buy of properties in a land ventures enrolled u/s 3 of the Act without getting enlistment under section 9.
ii. Each land specialist might influence an application to the Authority for enlistment in such to frame, way inside such time and joined by such charge and reports as may endorsed in separate State’s rules.
iii. The Authority might allow a solitary enrollment to land operator for the whole State or Union domain.
iv. Each enlisted real estate agent should cite his enrollment number in each deal encouraged by him under this Act.
Each land operator enlisted u/s 9 should:
a) Not encourage the deal or buy of any plot, condo or working, in a land undertaking or part of it, being sold by the promoter in any arranging zone, which isn’t enrolled with the Authority,
b) Maintain and protect such books of record, records and reports as may endorsed,
c) Not include him in any uncalled for exchange rehearses,
d) Facilitate the ownership of all the data and reports, as the allottee, is qualified for, at the season of booking of any plot, loft or building,
e) Discharge such different capacities as might be recommended.
